The requirement ensures proper <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_50263633\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"50263633\">separation of powers<\/span> by limiting judicial intervention to actual legal conflicts between <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_50263632\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"50263632\">adverse parties<\/span>.<\/p>\n\n    <\/div>\n\n\n\n<p>Just because you <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_50263638\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"50263638\">sue<\/span> someone in an American court doesn\u2019t mean <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_50263619\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"50263619\">the court<\/span> can actually hear your case. The U.S. Constitution sets up certain <a href=\"https:\/\/constitution.findlaw.com\/article3\/annotation11.html\" target=\"false\">\u201c<span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_50263651\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"50263651\">justiciability<\/span>\u201d requirements<\/a> for the <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_50263617\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"50263617\">federal courts<\/span>. This means that these courts are only allowed to hear and decide on a case if it meets certain conditions. These requirements are mostly rooted in <a href=\"https:\/\/constitution.findlaw.com\/article3.html\" target=\"false\"><span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_50263613\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"50263613\">Article III<\/span><\/a>, Section 2 of the Constitution.<\/p>\n<p>Along with <a href=\"https:\/\/constitution.findlaw.com\/article3\/annotation10.html\" target=\"_self\"><span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_50263660\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"50263660\">standing requirements<\/span><\/a>, which require a federal <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_50263621\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"50263621\">plaintiff<\/span> to prove <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_50263634\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"50263634\">injury in fact<\/span>, <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_50263658\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"50263658\">causation<\/span> connected to the defendant, and redressability by <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_50263619\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"50263619\">the courts<\/span>, the adversity requirement ensures that both sides of a lawsuit have an independent stake in the case.<\/p>\n<p>In this article, we\u2019ll discuss what makes parties \u201cadverse\u201d under <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_50263617\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"50263617\">federal <\/span><span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_50263678\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"50263678\">court<\/span><span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_50263678\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"50263678\"> jurisdiction<\/span>.<\/p>\n<h2>What Is the Adversity Requirement in <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_50263613\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"50263613\">Article III<\/span>?<\/h2>\n<p>This part of the Constitution says that <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_50263617\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"50263617\">federal courts<\/span> can only hear &#8220;cases&#8221; and &#8220;<span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_50263614\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"50263614\">controversies<\/span>.&#8221; But what does that mean? Let\u2019s take a look at the exact text.<\/p>\n<p><span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_50263613\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"50263613\">Article III<\/span>, Section 2, Clause 1 states:<\/p>\n<p><em>The <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_50263620\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"50263620\">judicial Power<\/span> shall extend to all Cases, in Law and Equity, arising under this Constitution, the Laws of the United States, and Treaties made, or which shall be made, under their Authority;\u2014to all Cases affecting Ambassadors, other public Ministers and <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_50263681\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"50263681\">Consuls<\/span>;\u2014to all Cases of admiralty and <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_50263682\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"50263682\">maritime Jurisdiction<\/span>; to <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_50263614\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"50263614\">Controversies<\/span> to which the United States shall be a Party;\u2014to <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_50263614\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"50263614\">Controversies<\/span> between two or more States; between a State and <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_50263653\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"50263653\">Citizens of another State<\/span>, between <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_50263652\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"50263652\">Citizens of different States<\/span>,\u2014between Citizens of the same State claiming Lands under Grants of different States, and between a State, or the Citizens thereof, and foreign States, Citizens or Subjects.<\/em><\/p>\n<p>The Constitution does not explicitly use the term &#8220;<span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_50263632\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"50263632\">adverse parties<\/span>.&#8221; Nor does it directly state that <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_50263617\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"50263617\">federal courts<\/span> can only hear cases between <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_50263632\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"50263632\">adverse parties<\/span>. But the U.S. <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_50263616\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"50263616\">Supreme Court<\/span> (SCOTUS) has read this case or <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_50263675\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"50263675\">controversy<\/span><span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_50263675\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"50263675\"> requirement<\/span> into the Constitution over hundreds of years of <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_50263646\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"50263646\">court decisions<\/span>.<\/p>\n<p>In <a href=\"https:\/\/caselaw.findlaw.com\/court\/us-supreme-court\/392\/83.html\" target=\"false\" rel=\"noopener\"><em><span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_50263629\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"50263629\">Flast v. Cohen<\/span><\/em><\/a>, SCOTUS noted that \u201cuncertainty exists in the doctrine of <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_50263651\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"50263651\">justiciability<\/span> because that doctrine has become a blend of constitutional requirements and policy considerations.\u201d<\/p>\n<p><span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_50263619\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"50263619\">The Court<\/span> has interpreted the &#8220;case and <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_50263614\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"50263614\">controversies<\/span>&#8221; language of <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_50263613\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"50263613\">Article III<\/span>, Section 2 to mean that there must be opposing parties with real, competing interests at stake if a case is to be decided by a <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_50263617\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"50263617\">federal court<\/span>.<\/p>\n<p>The U.S. <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_50263616\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"50263616\">Supreme Court<\/span> has interpreted four main \u201c<a href=\"https:\/\/constitution.findlaw.com\/article3\/annotation11.html\" target=\"false\"><span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_50263651\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"50263651\">justiciability<\/span> doctrines<\/a>\u201d from this text. They are:<\/p>\n<ul>\n<li>\n<p><a href=\"https:\/\/constitution.findlaw.com\/article3\/annotation10.html\" target=\"false\">Standing<\/a><\/p>\n<\/li>\n<li>\n<p><a href=\"https:\/\/constitution.findlaw.com\/article3\/the-ripeness-doctrine.html\" target=\"false\"><span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_50263673\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"50263673\">Ripeness<\/span><\/a><\/p>\n<\/li>\n<li>\n<p><a href=\"https:\/\/constitution.findlaw.com\/article3\/the-mootness-doctrine.html\" target=\"false\"><span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_50263674\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"50263674\">Mootness<\/span><\/a><\/p>\n<\/li>\n<li>\n<p><a href=\"https:\/\/constitution.findlaw.com\/article3\/annotation12.html\" target=\"false\">Political question doctrine<\/a><\/p>\n<\/li>\n<\/ul>\n<p>Another important requirement is that a <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_50263617\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"50263617\">federal court<\/span> can only hear actual disputes between genuinely<em> <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_50263632\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"50263632\">adverse <\/span><\/em><span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_50263632\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"50263632\">parties<\/span>. This principle ensures that <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_50263617\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"50263617\">federal courts<\/span> operate within the role set by the Constitution, preserving the <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_50263633\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"50263633\">separation of powers<\/span>. It also avoids <a href=\"https:\/\/constitution.findlaw.com\/article3\/what-are-advisory-opinions-.html\" target=\"false\"><span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_50263631\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"50263631\">advisory opinions<\/span><\/a> (giving general advice without a concrete case study) and limits <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_50263657\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"50263657\">federal <\/span><span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_50263620\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"50263620\">judicial power<\/span>.<\/p>\n<p>In other words, it prevents the <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_50263636\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"50263636\">judicial branch<\/span> from overstepping into the policy-making domains of the legislative and <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_50263625\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"50263625\">executive branches<\/span>. The law was challenged by a woman whose wife had died, and who was seeking an exemption to the federal estate tax.<\/p>\n<p>Although the <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_50263625\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"50263625\">executive branch<\/span> decided to continue enforcing DOMA, the <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_50263655\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"50263655\">federal government<\/span> did not defend the law in court. One wanted to avoid the <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_50263698\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"50263698\">federal agency<\/span>&#8216;s enforcement action while the agency wanted to proceed with it.<\/p>\n<p><span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_50263619\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"50263619\">The Court<\/span> concluded that the case still presented sufficient adversity, even though the parties agreed \u201con the merits of the <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_50263679\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"50263679\">constitutional question<\/span>.\u201d<\/p>\n<h2>\u201cFriendly\u201d or \u201cFeigned\u201d Lawsuits<\/h2>\n<p>Adversity is missing when two sides work together to bring a &#8220;friendly&#8221; lawsuit just to get a legal question answered. The 1850 case of <a href=\"https:\/\/caselaw.findlaw.com\/court\/us-supreme-court\/49\/251.html\" target=\"_self\" rel=\"noopener\"><em>Lord v. Veazie<\/em><\/a> is an important example of this, and it may be the first U.S. case to make the adversity requirement clear.<\/p>\n<p>In this case, Lord and Veazie filed a &#8220;friendly suit&#8221; to get <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_50263619\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"50263619\">the court<\/span>\u2019s opinion about some steamboat operating rights. Both sides actually wanted the same result and were working together. Veazie had given some rights to Lord, and the &#8220;dispute&#8221; was really just set up to test those rights against what a third party claimed.<\/p>\n<p><span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_50263641\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"50263641\">Chief Justice<\/span> Roger Taney, writing for the whole Court, strongly criticized this. Taney wrote:<\/p>\n<p>&#8220;It is the duty of a court to decline jurisdiction in such a case, although the parties concerned may desire to have the judicial opinion.&#8221;<\/p>\n<p>He made clear that when there is no real disagreement, <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_50263619\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"50263619\">the court<\/span> cannot decide the case, and it would be a &#8220;fraud upon <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_50263619\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"50263619\">the court<\/span>&#8221; to do so.<\/p>\n<p>Still, some famous constitutional decisions have come from cases where the parties were friendly and set up the lawsuit, sometimes even with one side paying for both. There are also cases where the disagreement seems to fade, like when one side stops defending a law.<\/p>\n<p>In these situations, courts may still hear the case if another party with a real interest joins in (like BLAG in Windsor), or if the case started with a real disagreement and there are still real-world effects. This allows the <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_50263616\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"50263616\">Supreme Court<\/span> and <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_50263626\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"50263626\">lower courts<\/span> to decide the case.<\/p>\n<p>The crucial factor is whether the parties have something concrete to gain or lose based on <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_50263619\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"50263619\">the <\/span><span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_50263646\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"50263646\">court<\/span><span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_50263646\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"50263646\">&#8216;s decision<\/span>, not whether they are personally antagonistic toward each other.<\/p>\n<h2><strong>Stockholder Lawsuits<\/strong><\/h2>\n<p>Courts have often found real disagreements sufficient for the adversity requirement in cases where stockholders <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_50263638\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"50263638\">sue<\/span> their own companies to challenge whether a law or government action is constitutional.
