The legislative branch is in charge of creating new laws. Article I lays the foundation for a bicameral legislature, a lawmaking body made up of two chambers: The Senate and the House of Representatives. Together, these two bodies are known as Congress.

Article I grants specific powers to Congress and reserves others for different branches of the government, such as the executive powers. For example, Congress is responsible for levying taxes, including income tax. The Constitution also outlines the privileges and immunities that come with being a member of Congress, such as immunity from criminal prosecutions.

However, like most areas of constitutional law, there are limits on the power given to Congress. Part of the Supreme Court’s judicial power (thanks to Marbury v. Madison) is determining whether actions by other branches of government comply with the constitution.

Our compilation of resources on Article I and the rest of the Constitution examine the meaning of the U.S. Constitution’s text, as interpreted by the Supreme Court.
