However, cases on <span data-term-id=\"55325925\">interstate travel<\/span> also often touch on <span data-term-id=\"55325932\">Article IV<\/span>. It is essential to note that these cases primarily concern <span data-term-id=\"55325925\">interstate travel<\/span>. This concept is distinct from <span data-term-id=\"55325948\">intrastate travel<\/span>, which means movement within a single state. <span data-term-id=\"55325948\">Intrastate travel<\/span> is governed by different <span data-term-id=\"55325962\">state laws<\/span>.<\/p>\n<h2><strong>Where Does the <span data-term-id=\"55325946\">Constitutional <\/span><span data-term-id=\"55325918\">Right<\/span><span data-term-id=\"55325946\"> to Travel<\/span> Come From?<\/strong><\/h2>\n<p>It is easy to get tangled up when searching for the roots of the <span data-term-id=\"55325918\">right to travel<\/span>. Even the <span data-term-id=\"55325919\">Supreme Court<\/span> doesn\u2019t point directly to its origin. In 1999, <span data-term-id=\"55325926\">U.S. <\/span><span data-term-id=\"55325919\">Supreme Court<\/span> Justice John Paul Stevens wrote in <a href=\"https:\/\/caselaw.findlaw.com\/court\/us-supreme-court\/526\/489.html\" target=\"_blank\" rel=\"noopener noreferrer nofollow\"><em><span data-term-id=\"55325923\">Saenz v. Roe<\/span><\/em><\/a>:<\/p>\n<p>\u201cFor the purposes of this case, we need not identify the source of the <span data-term-id=\"55325918\">right to travel<\/span> in the text of the Constitution. The right of \u2018<span data-term-id=\"55325931\">free ingress<\/span> and regress to and from\u2019 neighboring states, which was expressly mentioned in the text of the <a href=\"https:\/\/supreme.findlaw.com\/documents\/aofc.html\" target=\"_blank\" rel=\"noopener noreferrer nofollow\"><span data-term-id=\"55325929\">Articles of Confederation<\/span><\/a>, may simply have been \u2018conceived from the beginning to be a necessary concomitant of the stronger Union the Constitution created.\u201d<\/p>\n<p>Even though the Court doesn&#8217;t pinpoint one exact source, it points to several <span data-term-id=\"55325943\">constitutional provisions<\/span> working together.\u00a0<a href=\"https:\/\/constitution.findlaw.com\/article4.html\" target=\"_blank\" rel=\"noopener noreferrer nofollow\"><span data-term-id=\"55325932\">Article IV<\/span><\/a> of the <span data-term-id=\"55325921\">U.S. Constitution<\/span> states, in part:<\/p>\n<p><em>\u201cThe <span data-term-id=\"55325950\">Citizens of each State<\/span> shall be entitled to all Privileges and Immunities of Citizens in the several States&#8230;\u201d<\/em><\/p>\n<p>This means that state governments\u00a0must treat all\u00a0American\u00a0citizens equally, whether they are visitors to the state or residents. The <span data-term-id=\"55325927\">Fourteenth Amendment<\/span> also addresses privileges and immunities, along with its guarantees of <span data-term-id=\"55325947\">due process<\/span><span data-term-id=\"55325947\"> of law<\/span> and equal protection under the law.<\/p>\n<p>Essentially, the <span data-term-id=\"55325919\">Supreme Court<\/span> views the <span data-term-id=\"55325918\">right to travel<\/span> as essential to the \u201cunited\u201d part of the United States.<\/p>\n<h2><strong>The <span data-term-id=\"55325927\">Fourteenth Amendment<\/span><\/strong><\/h2>\n<p><a href=\"https:\/\/constitution.findlaw.com\/amendment14.html\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">The <span data-term-id=\"55325927\">Fourteenth Amendment<\/span><\/a> encompasses a broad range of provisions. Congress passed it in 1866, after the Civil War, during the era known as Reconstruction. Most significantly, the amendment granted citizenship to \u201call persons born or naturalized in the United States.\u201d This meant that people who were formerly enslaved were now citizens.<\/p>\n<p>Other important sections of the <span data-term-id=\"55325927\">Fourteenth Amendment<\/span> include:<\/p>\n<ul>\n<li><a href=\"https:\/\/constitution.findlaw.com\/amendment14\/annotation02.html\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">The <span data-term-id=\"55325928\">privileges and immunities clause<\/span><\/a><\/li>\n<li><a href=\"https:\/\/constitution.findlaw.com\/amendment14\/annotation04.html\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">The <span data-term-id=\"55325953\">equal protection clause<\/span><\/a><\/li>\n<li><a href=\"https:\/\/constitution.findlaw.com\/amendment14\/annotation03.html\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">The <span data-term-id=\"55325922\">due process<\/span> clause<\/a><\/li>\n<li><a href=\"https:\/\/constitution.findlaw.com\/amendment14\/annotation15.html\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">The disqualification clause<\/a><\/li>\n<\/ul>\n<p>Laws that hinder a person\u2019s ability to travel between states are often analyzed under the <span data-term-id=\"55325928\">privileges and immunities clause<\/span> or the <span data-term-id=\"55325953\">equal protection clause<\/span>.<\/p>\n<h3><strong>The <span data-term-id=\"55325928\">Privileges and Immunities Clause<\/span><\/strong><\/h3>\n<p>The <span data-term-id=\"55325927\">Fourteenth Amendment<\/span> established that everyone \u201cborn or naturalized\u201d in the U.S. is a citizen of the United States and of the state where they live. The <span data-term-id=\"55325928\">privileges and immunities clause<\/span> states that:<\/p>\n<p><em>\u201cNo State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States&#8230;\u201d<\/em><\/p>\n<p>This aimed to put all citizens on equal footing and prevent states from discriminating against Black Americans. However, the <span data-term-id=\"55325919\">Supreme Court\u2019s<\/span> decision in the <a href=\"https:\/\/supreme.findlaw.com\/supreme-court-insights\/the-slaughterhouse-cases--decision-summary-and-impact.html\" target=\"_blank\" rel=\"noopener noreferrer nofollow\"><em>Slaughterhouse Cases<\/em><\/a> significantly narrowed its application. In that case, the Court held that the <span data-term-id=\"55325927\">Fourteenth Amendment<\/span>\u2019s <span data-term-id=\"55325928\">privileges and immunities clause<\/span> only protects a person&#8217;s rights as a U.S. citizen. Privileges of state citizenship are protected only by <span data-term-id=\"55325932\">Article IV<\/span>.<\/p>\n<h3><strong>The <span data-term-id=\"55325953\">Equal Protection Clause<\/span><\/strong><\/h3>\n<p>The <a href=\"https:\/\/constitution.findlaw.com\/amendment14\/annotation04.html\" target=\"_blank\" rel=\"noopener noreferrer nofollow\"><span data-term-id=\"55325953\">equal protection clause<\/span><\/a> of the <span data-term-id=\"55325927\">Fourteenth Amendment<\/span> states:<\/p>\n<p>\u201c<em>[No state shall]<\/em> <em>deny to any person within its jurisdiction the equal protection of the laws.\u201d<\/em><\/p>\n<h2><strong><span data-term-id=\"55325935\">Durational Residency Requirements<\/span><\/strong><\/h2>\n<p>A <span data-term-id=\"55325935\">durational residency requirement<\/span> means a person must reside in a state for a specified period before they can exercise certain privileges. These <span data-term-id=\"55325951\">waiting periods<\/span> can range from months to years. For example, some states require you to live there for at least a year before becoming eligible for in-state tuition at public universities.<\/p>\n<p>In <a href=\"https:\/\/caselaw.findlaw.com\/court\/us-supreme-court\/394\/618.html\" target=\"_blank\" rel=\"noopener noreferrer nofollow\"><em><span data-term-id=\"55325939\">Shapiro v. Thompson<\/span><\/em><\/a> (1969), the <span data-term-id=\"55325919\">Supreme Court<\/span> held that <span data-term-id=\"55325935\">durational residency requirements<\/span> are invalid. This is unless the state can prove they are necessary to further a &#8220;compelling <span data-term-id=\"55325934\">government interest<\/span>.&#8221; This standard is known as \u201cstrict scrutiny.\u201d The strict scrutiny standard is the highest level of review courts use when determining whether a law is constitutional.<\/p>\n<p>Residency requirements can also impact the right to vote. In <a href=\"https:\/\/caselaw.findlaw.com\/court\/us-supreme-court\/405\/330.html\" target=\"_blank\" rel=\"noopener noreferrer nofollow\"><em><span data-term-id=\"55325949\">Dunn v. Blumstein<\/span><\/em><\/a> (1972), the <span data-term-id=\"55325919\">Supreme Court<\/span> struck down a Tennessee law. It required a person to reside in the state for one year and in their current county for three months before they could register to vote. The Court found the law infringed on both the right to vote and the <span data-term-id=\"55325918\">right to travel<\/span>.<\/p>\n<p>In\u00a0<a href=\"https:\/\/caselaw.findlaw.com\/court\/us-supreme-court\/415\/250.html\" rel=\"noopener\"><em><span data-term-id=\"55325942\">Memorial Hospital v. Maricopa County<\/span><\/em>\u00a0<em>(1974)<\/em><\/a>, the <span data-term-id=\"55325919\">Supreme Court<\/span> invalidated Arizona laws. They required people to reside in a county for one year before receiving nonemergency medical care at public expense. The Court determined that medical services constitute basic necessities. Denying them to new residents while providing them to established residents effectively penalizes <span data-term-id=\"55325925\">interstate travel<\/span>.<\/p>\n<h2><strong>Early Landmark Cases on the <span data-term-id=\"55325918\">Right to Travel<\/span><\/strong><\/h2>\n<p>One of the earliest <span data-term-id=\"55325919\">Supreme Court<\/span> cases to address the <span data-term-id=\"55325918\">right to travel<\/span> was\u00a0<a href=\"https:\/\/caselaw.findlaw.com\/court\/us-supreme-court\/73\/35.html\" rel=\"noopener\"><em><span data-term-id=\"55325940\">Crandall v. Nevada<\/span><\/em>\u00a0<em>(1867)<\/em><\/a>. In this landmark decision, the Court struck down a Nevada statute. This law imposed a one-dollar tax on every passenger leaving the state.<\/p>\n<p>Writing for the majority, Justice Samuel Miller emphasized that the &#8220;people of the United States constitute one nation&#8221;. He added that the citizens should have the right to move freely between states. The Court noted that if the State can impose a one-dollar tax on passengers, it can impose a one-thousand-dollar tax. It added that if one State can impose such a tax, so can other states. This can result in barriers to interstate movement. The tax can significantly burden all transportation of passengers, particularly when moving from one state to another.<\/p>\n<p>The significance of\u00a0<em>Crandall<\/em> established that states cannot impose financial obstacles that burden the exercise of <span data-term-id=\"55325924\">constitutional rights<\/span>. They cannot impose this burden, even if it appears minimal. As noted by Justice Miller, it was not the amount of tax but the right of the state to impose tax in such a manner. This case remains relevant in modern times, particularly in the context of <span data-term-id=\"55325925\">interstate travel<\/span>.<\/p>\n<p>Another pivotal case,\u00a0<a class=\"underline\" href=\"https:\/\/caselaw.findlaw.com\/court\/us-supreme-court\/314\/160.html\" target=\"_blank\" rel=\"noopener noreferrer nofollow\"><em><span data-term-id=\"55325945\">Edwards v. California<\/span> (1941)<\/em><\/a>, addressed\u00a0California&#8217;s statute during the Great Depression. This law made it a misdemeanor to knowingly bring or assist in the bringing into the state an indigent person. The <span data-term-id=\"55325919\">Supreme Court<\/span> unanimously struck down this law.<\/p>\n<p>The majority opinion by Justice James Byrnes relied on the Commerce Clause. It held that transporting persons across state lines constitutes interstate commerce. This is subject to regulation by the <span data-term-id=\"55325944\">federal government<\/span>. However, four concurring justices preferred to ground the decision in the <span data-term-id=\"55325930\">Privileges or Immunities Clause<\/span> of the <span data-term-id=\"55325927\">Fourteenth Amendment<\/span>. Justice William O. Douglas wrote that the right of persons to travel from one state to another is in a more protected position in the Constitution. It is not the same as moving fruit, cattle, steel, or other goods across state lines.<\/p>\n<h2><strong>Federal Protection of <span data-term-id=\"55325925\">Interstate Travel<\/span> Rights<\/strong><\/h2>\n<p>The <span data-term-id=\"55325919\">Supreme Court<\/span> reaffirmed and expanded the <span data-term-id=\"55325918\">right to travel<\/span> in\u00a0<a href=\"https:\/\/caselaw.findlaw.com\/court\/us-supreme-court\/383\/745.html\" rel=\"noopener\"><em><span data-term-id=\"55325938\">United States v. Guest<\/span><\/em>\u00a0<em>(1966)<\/em><\/a>. The case involved six defendants accused of conspiring to prevent African American citizens near Athens, Georgia, from exercising their <span data-term-id=\"55325924\">constitutional rights<\/span> to travel between states.<\/p>\n<p>Justice Potter Stewart, writing for a unanimous Court, declared that the <span data-term-id=\"55325924\">constitutional right<\/span> to move from one state to another is &#8220;fundamental to the concept of our Federal Union.&#8221; This means the Constitution protects your ability to pass and repass through state lines without interference.<\/p>\n<h3><strong>Regulations on <span data-term-id=\"55325959\">Driver&#8217;s Licenses<\/span><\/strong><\/h3>\n<p>The <span data-term-id=\"55325946\">constitutional <\/span><span data-term-id=\"55325918\">right<\/span><span data-term-id=\"55325946\"> to travel<\/span> has sparked debate about whether states can <a href=\"https:\/\/www.findlaw.com\/traffic\/drivers-license-vehicle-info\/what-is-the-right-to-travel.html\" rel=\"noopener\">require <span data-term-id=\"55325959\">driver&#8217;s licenses<\/span><\/a>.\u00a0Some individuals have claimed that the <span data-term-id=\"55325946\">constitutional <\/span><span data-term-id=\"55325918\">right<\/span><span data-term-id=\"55325946\"> to travel<\/span> means states cannot require <span data-term-id=\"55325959\">driver&#8217;s licenses<\/span>. This applies to operating motor vehicles on public roads.<\/p>\n<p>However, courts have consistently rejected this interpretation. While the Constitution protects the right to move freely between states, this does not mean operating a motor vehicle is exempt from reasonable safety regulations.\u00a0States have the legal authority to regulate public highways for safety purposes. This power includes requiring <span data-term-id=\"55325959\">driver&#8217;s licenses<\/span>, vehicle registration, and insurance.<\/p>\n<p>The <span data-term-id=\"55325919\">Supreme Court<\/span> addressed this distinction in\u00a0<a class=\"underline\" href=\"https:\/\/supreme.justia.com\/cases\/federal\/us\/235\/610\/\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">Hendrick v. Maryland (1915).<\/a> The case involved Maryland&#8217;s motor vehicle law, which required both vehicle registration and driver&#8217;s licensing. The Court upheld the law. It explained that when Congress hasn&#8217;t passed national legislation on a topic, states can create safety regulations for their highways. This includes requiring vehicle registration and <span data-term-id=\"55325959\">driver&#8217;s licenses<\/span>.<\/p>\n<p>The key principle is that <span data-term-id=\"55325920\">fundamental rights<\/span>, including the <span data-term-id=\"55325918\">right to travel<\/span>, can be subject to reasonable regulations that serve legitimate <span data-term-id=\"55325934\">government interests<\/span>.\u00a0<span data-term-id=\"55325959\">Driver&#8217;s license<\/span> requirements are considered reasonable safety measures. It constitutes an exercise of the <span data-term-id=\"55325957\">police power<\/span> uniformly recognized as belonging to the states. It is essential to the preservation of the health, safety, and comfort of their citizens.
