This <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_50005733\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"50005733\">constitutional<\/span> guarantee ensures judges must remain neutral and avoid conflicts of interest that could affect their decision-making. When bias appears likely, judges must recuse themselves or face <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_50005730\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"50005730\">disqualification<\/span> to preserve the integrity of legal proceedings.<\/p>\n\n    <\/div>\n\n\n\n<p>Unbiased judges are a key component in protecting against <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_50005772\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"50005772\">due process violations<\/span> in the <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_50005791\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"50005791\">judicial system<\/span>. <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_50005742\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"50005742\">Trial judges<\/span> must apply the law impartially and maintain <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_50005775\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"50005775\">objective standards<\/span>.<\/p>\n<p>The <a href=\"https:\/\/constitution.findlaw.com\/amendment5.html\" target=\"_blank\" rel=\"noopener\">Fifth Amendment<\/a>&#8216;s <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_50005737\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"50005737\">due process clause<\/span> requires the federal government to follow certain processes before depriving a person of life, liberty, or property. The <a href=\"https:\/\/constitution.findlaw.com\/amendment14\/annotation03.html#:~:text=The%20Fourteenth%20Amendment%20states%20that,others%20related%20to%20criminal%20proceedings.\" target=\"_blank\" rel=\"noopener\">Fourteenth Amendment<\/a> then extended this due process right to all states. In criminal cases, due process includes the right to a <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_50005768\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"50005768\">fair trial<\/span>.<\/p>\n<p>However, this does not mean judges, as <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_50005780\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"50005780\">decision-makers<\/span> on a <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_50005788\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"50005788\">particular case<\/span>, are not at <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_50005751\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"50005751\">risk of <\/span><span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_50005735\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"50005735\">actual bias<\/span>. This article explores the importance of due process, particularly in criminal trials. We also explore the importance of <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_50005730\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"50005730\">disqualification<\/span> and <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_50005731\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"50005731\">recusal<\/span> in maintaining the <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_50005748\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"50005748\">judiciary<\/span>&#8216;s <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_50005732\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"50005732\">impartiality<\/span>.<\/p>\n<h2>Identifying Judicial Bias<\/h2>\n<p>The cases below illustrate the <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_50005759\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"50005759\">U.S. Supreme Court<\/span>&#8216;s responses to issues of <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_50005770\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"50005770\">partiality<\/span> within <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_50005782\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"50005782\">state courts<\/span>. They scrutinize the dangers of <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_50005735\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"50005735\">actual bias<\/span>, as well as the perception of bias, and their impact on the decisions of the <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_50005784\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"50005784\">trial courts<\/span>.<\/p>\n<h3><span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_50005757\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"50005757\">Financial Interest<\/span><\/h3>\n<p><span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_50005777\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"50005777\">Judicial <\/span><span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_50005732\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"50005732\">impartiality<\/span> is often questioned when the judge overseeing the proceedings has a vested economic interest in the case&#8217;s outcome.<\/p>\n<p>In <a href=\"https:\/\/caselaw.findlaw.com\/court\/us-supreme-court\/273\/510.html\" target=\"_blank\" rel=\"noopener\"><em><span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_50005773\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"50005773\">Tumey v<\/span>. <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_50005767\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"50005767\">Ohio<\/span><\/em><\/a>, the Court found that a criminal defendant&#8217;s <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_50005765\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"50005765\">constitutional<\/span><span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_50005765\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"50005765\"> rights<\/span> were violated because the <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_50005784\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"50005784\">trial court<\/span> judge had a <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_50005769\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"50005769\">pecuniary interest<\/span> in the trial&#8217;s outcome. In this case, the judge received a percentage of the fines levied against convicted defendants. More convictions resulted in greater compensation for the judge. The Court held that a <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_50005757\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"50005757\">financial interest<\/span> in the trial&#8217;s outcome could affect the <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_50005747\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"50005747\">judge&#8217;s <\/span><span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_50005732\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"50005732\">impartiality<\/span>, regardless of the strength of the evidence.<\/p>\n<p>In <a href=\"https:\/\/caselaw.findlaw.com\/court\/us-supreme-court\/409\/57.html\" target=\"_blank\" rel=\"noopener\"><em><span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_50005793\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"50005793\">Ward v<\/span>. <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_50005794\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"50005794\">Monroeville<\/span><\/em><\/a>, the Court took this conclusion further. In this case, the town&#8217;s mayor was also a judge. Although the mayor did not personally benefit from court costs, <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_50005738\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"50005738\">the Supreme Court<\/span> held that prejudice could still arise. A substantial portion of fines, forfeitures, and fees contributed to the town&#8217;s finances. Therefore, the Court found it was inappropriate for the mayor, who is in charge of revenue, to become the trier of fact.<\/p>\n<h3><span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_50005778\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"50005778\">Criminal Contempt<\/span><\/h3>\n<p>A judge may find a party or their lawyer in <a href=\"https:\/\/dictionary.findlaw.com\/definition\/contempt.html#:~:text=%3A%20contempt%20consisting%20of%20conduct%20that,well%20as%20to%20coerce%20compliance.\" target=\"_blank\" rel=\"noopener\">contempt<\/a> if they fail to follow the Court&#8217;s orders or behave unruly while in the courtroom. For example, a judge may issue a <a href=\"https:\/\/dictionary.findlaw.com\/definition\/gag-order.html\" target=\"_blank\" rel=\"noopener\">gag order<\/a> in cases involving high-profile defendants. This restricts parties from making public statements or sharing case details with the media to protect the integrity of the proceedings. Juries are susceptible to bias when exposed to inadmissible information. The jury should only contemplate admitted evidence rather than take sides based on <a href=\"https:\/\/www.findlaw.com\/legalblogs\/strategist\/could-remarks-from-public-officials-on-chauvin-trial-be-grounds-for-appeal\/#:~:text=Can%20High-Profile%20Defendants%20Get%20a%20Fair%20Trial%3F\" target=\"_blank\" rel=\"noopener\">the Court of public opinion<\/a>.<\/p>\n<p>In <a href=\"https:\/\/caselaw.findlaw.com\/court\/us-supreme-court\/400\/455.html\" target=\"_blank\" rel=\"noopener\"><em><span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_50005790\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"50005790\">Mayberry v<\/span>. Pennsylvania<\/em><\/a>, a criminal defendant representing himself made slanderous remarks, disrupted jury instructions, and was unruly throughout his criminal trial. The <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_50005742\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"50005742\">trial judge<\/span> found Mayberry guilty of <a href=\"https:\/\/dictionary.findlaw.com\/definition\/contempt.html#:~:text=%3A%20contempt%20consisting%20of%20conduct%20that,well%20as%20to%20coerce%20compliance.\" target=\"_blank\" rel=\"noopener\">contempt<\/a> on 11 of the 21 days of trial and sentenced him to up to 22 years for the contempt alone.<\/p>\n<p><span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_50005738\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"50005738\">The Supreme Court<\/span> found that &#8220;no one so cruelly slandered is likely to maintain that calm detachment necessary for fair adjudication.&#8221; The defendant, in this case, went beyond mere distractions. Instead, the Court found Mayberry used &#8220;fighting words.&#8221;Judicial officers are not so sensitive that they need to recuse themselves from every insult thrown their way to prevent the <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_50005760\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"50005760\">appearance of bias<\/span> in a heated dispute. However, the Court determined that a different judicial officer should preside over the contempt proceedings.<\/p>\n<p>In another case, <a href=\"https:\/\/caselaw.findlaw.com\/court\/us-supreme-court\/349\/133.html\" target=\"_blank\" rel=\"noopener\"><em>In re <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_50005750\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"50005750\">Murchison<\/span> <\/em>(1955)<\/a>, the Court found a &#8220;one-man judge-grand jury&#8221; violated a criminal defendant&#8217;s due process. A Michigan law allowed judges to act as a one-person <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-procedure\/how-does-a-grand-jury-work.html\" target=\"_blank\" rel=\"noopener\">grand jury.<\/a> Witnesses testify before a grand jury in secret to help determine whether there is probable cause to charge someone with a crime.<\/p>\n<p>The judge in <em><span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_50005750\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"50005750\">Murchison<\/span> <\/em>believed one grand jury witness had committed <a href=\"https:\/\/dictionary.findlaw.com\/definition\/perjury.html\" target=\"_blank\" rel=\"noopener\">perjury. <\/a>Another stopped answering the judge&#8217;s questions and invoked his right to counsel. The judge charged both witnesses with contempt and presided over their trials.<\/p>\n<p><span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_50005738\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"50005738\">The Supreme Court<\/span> found that this violated due process. The defendant did not have any public witnesses to cross-examine. Moreover, because grand jury proceedings are secretive, the judge became a <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_50005771\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"50005771\">material witness<\/span>. This further denied the defendant the right to cross-examine him because the judge was also the trier of fact. The Court concluded, &#8220;No man can be a judge in his own case.&#8221;<\/p>\n<h3><span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_50005741\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"50005741\">Campaign Contributions<\/span><\/h3>\n<p>The process of appointing federal judges differs from the process of electing state judges. Article II of the <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_50005733\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"50005733\">Constitution<\/span> states that the president nominates federal judges who the U.S. Senate then confirms. Such judges include:<\/p>\n<ul>\n<li>\n<p><span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_50005763\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"50005763\">Supreme Court justices<\/span><\/p>\n<\/li>\n<li>\n<p>Federal <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_50005787\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"50005787\">appellate judges<\/span><\/p>\n<\/li>\n<li>\n<p>Federal district court judges<\/p>\n<\/li>\n<\/ul>\n<p>On the other hand, the process to become a <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_50005782\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"50005782\">state court<\/span> judge varies by jurisdiction. Similar to the <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_50005792\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"50005792\">ABA<\/span>, this code includes guidance on how to perform judicial duties.
